Kan & Krishme is pleased to announce that Aakriti Vadehra, Partner at the Firm, will be speaking as the India representative at the Practising Law Institute (PLI) programme on Global Advertising Law: Year in Review for 2025.
The programme brings together Global Advertising Law Alliance (GALA) members from key jurisdictions like the US, Canada, Mexico and France, to examine the rapidly evolving regulatory landscape governing advertising, marketing, digital media, and consumer protection worldwide. It focuses on how global brands can navigate increasingly complex compliance obligations across markets, particularly in light of emerging data protection regimes, platform regulation, influencer marketing standards, and AI-driven content.
Representing India, Aakriti will address recent and forthcoming regulatory developments that are reshaping advertising and marketing practices in the country, including:
The implementation framework and compliance impact of the Digital Personal Data Protection Rules, 2025, with particular emphasis on consent architecture, data retention, children’s data, and breach reporting obligations;
India’s evolving stance on online gaming, promotions, and advertising, including the new statutory classification of online games and prohibitions affecting money-based gaming and related marketing;
Amendments to the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, especially obligations relating to AI-generated and synthetic content, labelling, traceability, and platform due diligence;
Recent updates to ASCI’s Influencer Advertising Guidelines, including heightened qualification and disclosure requirements for technical advice in health, nutrition, and financial services advertising;
Enforcement trends by the Central Consumer Protection Authority (CCPA), highlighting penalties imposed for misleading advertisements, pricing practices, and exaggerated claims; and
Judicial developments concerning personality rights, deepfakes, and AI-generated endorsements, including the increasing use of John Doe orders and interim injunctions by Indian courts.
The session also looks ahead to anticipated regulatory priorities for 2026, including enhanced AI-based monitoring of digital advertising and the phased implementation of additional data protection obligations.
