Daksh Oberoi is an Associate at Kan and Krishme with over three years of experience in Intellectual Property Law. His practice encompasses a broad range of intellectual property matters, with a particular focus on trademark, copyright, design and patent litigation and enforcement, Intellectual Property prosecution, advertising law, Intellectual Property-related agreements and advisory work.
Mr. Oberoi handles the drafting, filing and prosecution of trademark, copyright and industrial design applications before the Indian Intellectual Property Office. He has managed the prosecution of more than 100 Indian trademark, copyright and design applications and regularly advises clients on examination reports, hearings, oppositions and other proceedings before the Indian Intellectual Property Office.
On the contentious side, Mr. Oberoi is actively involved in trademark, copyright, design and patent litigation and enforcement. His experience includes handling infringement and enforcement proceedings, as well as appeals against orders and decisions passed by the Indian Intellectual Property Office. He assists senior counsel in proceedings before various High Courts in India and regularly represents clients in contentious Intellectual Property proceedings. He also advises domestic and international clients on strategies for protecting and enforcing their Intellectual Property rights against online and offline infringement.
Mr. Oberoi also advises clients on Indian advertising laws and regulatory compliance, including reviewing advertisements, promotional campaigns, influencer marketing content and other marketing communications to assess compliance with applicable laws, regulations and industry guidelines in India.
His practice further extends to Intellectual Property-related corporate and commercial matters, including Intellectual Property due diligence, review of Intellectual Property portfolios, ownership and assignment issues, Intellectual Property-related aspects of corporate transactions and restructuring, and strategies for protecting and managing Intellectual Property assets.
He has experience in drafting and reviewing a wide range of Intellectual Property and commercial agreements, including assignment agreements, licensing agreements, confidentiality agreements, coexistence agreements and other agreements involving Intellectual Property rights.
